    Sufficient LICENSE FOR CHEMICAL PRODUCTION

    Pursuant to: Clause 1, Article 3, Decree 113/2017/ND-CP, amended and supplemented by Clause 2, Article 8 of Decree 17/2020/ND-CP: “Chemical production means activities that generate chemicals. through chemical reactions, biochemical processes or physicochemical processes, physical such as extraction, concentration, dilution, mixing and other physicochemical and physical processes excluding chemical emission activities without purpose” .

    FULL CHEMICAL LICENSE LICENSE

    Pursuant to: Clause 2, Article 3 of Decree 113/2017/ND-CP: Chemical trading includes trading, exporting and importing chemicals to supply chemicals on the market for profit purposes.

    CONDITIONS FOR CERTIFICATION

    Sufficient LICENSE FOR CHEMICAL PRODUCTION

    Pursuant to: Clause 1, Article 9 of Decree 113/2017/ND-CP; Paragraph 3 of Article 8 and paragraph 1 of Article 9 of Decree 17/2020 / ND-CP.

    Being an organization or individual established in accordance with the law (with a certificate of business registration ); 

    Facility – Technical: Factories, warehouses and technology equipment; Equipment safety, prevention of fire, room, lightning, prevention leakage and dispersion of chemicals and other chemical incidents; Labor protection equipment; Equipment for environmental protection, waste treatment system; Transportation; Table rules on chemical safety; …. must meet specific conditions prescribed. This condition is evidenced by a certificate of eligibility for fire prevention and fighting or inspection reports to ensure safety throughout the fire prevention and fighting and certificates of registered committed to protecting the environment by agencies granting authority.  

    Technical director or deputy director or technical officer in charge of chemical production must have a university degree or higher in chemical major; 

    Employees must be trained in chemical safety, including: Heads of units, production and business establishments and affiliated departments and branches; in charge of production, sales and technical departments; workshop manager or equivalent; The deputy head of the head assigned to be in charge of chemical safety; Full-time and part-time staff in charge of chemical safety of the establishment; Persons directly supervising chemical safety at the workplace; workers directly involved in chemicals

    Being an enterprise, cooperative, or household business established in accordance with the law and having a business in chemicals; 

    Facility – Technical: Factories, warehouses and technology equipment; Safety equipment, fire and explosion prevention and fighting, lightning protection, prevention and control of chemical leakage and dispersion and other chemical incidents; Equipment for labor protection; Equipment for environmental protection, waste treatment systems; Transportation; Table rules on chemical safety; …. must meet specific conditions as prescribed (general requirements when trading chemicals are specified in Chapter II of Decree 113/2017); 

    Having a shop or place of business and sale that meets the requirements on chemical safety, fire prevention and fighting safety as prescribed by law; 

    Having a warehouse or having a contract to rent a chemical warehouse or use the warehouse of an organization or individual that buys or sells chemicals that satisfy the conditions for chemical safety, fire prevention and fighting safety; 

    The person in charge of chemical safety of a chemical trading establishment must have an intermediate or higher degree in chemicals; 

    Employees must be trained in chemical safety, including: The head of the unit, production facilities, sales and divisions, affiliates; in charge of production, sales and technical departments; workshop manager or equivalent; The deputy head of the head assigned to be in charge of chemical safety; Full-time and part-time staff in charge of chemical safety of the establishment; Persons directly supervising chemical safety at the workplace; workers directly involved in chemicals. 

    APPLICATION FOR CERTIFICATE

    Sufficient LICENSE FOR CHEMICAL PRODUCTION

    Pursuant to: Clause 1, Article 10, Decree 113/2017/ND-CP

    A written request for issuance of the Certificate of eligibility for production of chemicals subject to conditional production and trading in the industrial sector, made according to the form;      

    A copy of the Certificate of Business Registration or Certificate of Cooperative Registration or Certificate of Business Household Registration;      

    copy of the decision to approve or documents certifying the documents related to environmental protection under the law is the State management agencies competent Deciding n board operator      

    A copy of the certificate of approval of fire prevention and fighting design and the written approval of the acceptance of the fire prevention and fighting system of the competent authority for each production facility subject to the approval of the design of the fire prevention and fighting system. fire prevention and fighting design;      

    Minutes of safety inspections of fire prevention and fighting or documents of the competent authority to prove ensure the safety conditions for fire prevention and fighting for each manufacturing facility is not subject to mandatory fire prevention and fighting design must be appraised and approved;      

    Drawings overall system factory premises, warehouses, content drawing must ensure that information about the location of workshops, warehouses, storage areas chemicals, acreage and sugar factories, area chemical production and storage; A copy of the document proving the right to use the land plot for the construction of the factory or warehouse or the contract for renting the factory or warehouse .      

    The declaration of technical equipment, labor and safety equipment of the chemical production establishment;       

    A copy of a university degree or higher in chemical major of the director or deputy technical director or the technical officer in charge of chemical production activities of the manufacturing facility;      

    Copies of chemical safety training records ;      

    Chemical safety sheets of dangerous chemicals in the production facility according to regulations. 

    FULL CHEMICAL LICENSE LICENSE

    ▪A copy of the approval decision or written certification of documents related to environmental protection as prescribed by law issued by a competent state management agency;

    ▪A copy of the Certificate of Design Appraisal and the written acceptance of the fire prevention and fighting design issued by the competent authority for each chemical warehouse subject to the fire prevention and fighting design appraisal and approval;

    ▪Minutes of safety inspections of fire prevention and fighting or documents of the competent authority to prove ensure the safety conditions for fire prevention and fighting for each storage of chemicals not subject to compulsory fire prevention and fighting design must be appraised and approved;
    ▪Drawings overall ground system of each business location, the contents of drawings to ensure information about the location of storage, chemical storage areas, and roads in the area of chemical storage areas; Copies of documents proving the right to use the land plot to build storage or warehouse lease in case rent archive or contract or purchase agreement chemicals in case of using the repository of the organization, individuals buy or sell chemicals;

    AGENCIES COMPETENT

    Pursuant to: Clause 6, Article 10, Decree 113/2017/ND-CP

    The Department of Industry and Trade where the organization or individual locates their production and business establishments shall appraise and grant them.

    ORDER AND PROCEDURES FOR ASSESSMENT AND CERTIFICATION

    Pursuant to: Clause 3, Article 10, Decree 113/2017/ND-CP

    Step 1: The organization or individual applying for the Certificate shall make 01 dossier and send it by post or directly or through the online public service system to the Department of Industry and Trade where the chemical production and business activities are carried out.

    Step 2: If the dossier is incomplete and invalid, within 03 working days from the date of receiving the dossier, the agency certificate notice to organizations and individuals to supplement and complete the dossier. Complete time records do not count on time certificates.

    Step 3: Within 12 working days from the date of receipt of a complete and valid dossier, the Certificate-issuing agency shall consider, appraise and issue the Certificate of eligibility to the organization or individual, and concurrently send 01 copy to the Department of Industry and Trade where the organization or individual’s head office is registered.

    EXECUTION TIME

    15 working days, excluding the time to amend and supplement the dossier to be valid.

    Implementation time may take longer than expected because of waiting for the results of appraisal and inspection from state agencies.
